By downloading, installing, or using the Detour application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Minimum Age

You must be at least 13 years old to use Detour. If your jurisdiction requires a higher minimum age for using apps or online services, you must meet that local requirement. By using the App, you represent that you meet the applicable minimum age.

3. Description of Service

Detour is a digital wellbeing application that presents micro-learning challenges when you open apps you have designated as restricted. The App is designed as a self-management tool — it does not block, restrict, or control your device without your active participation.

Detour offers an optional premium subscription ("Detour+") with additional features including Accountability Connections. Core functionality is always free.

8. Intellectual Property & License

All content, design, code, challenge materials, and question banks within the App are the property of Detour and are protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not permit you to copy, modify, distribute, or reverse-engineer any part of the App.

You retain full ownership of your learning progress data and any data you export from the App.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be error-free, uninterrupted, or compatible with all devices.

10. Limitation of Liability

To the maximum extent permitted by law, Detour and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to loss of data, loss of profits, or damages resulting from reliance on the App.

11. Indemnification

You agree to indemnify, defend, and hold harmless Detour and its developers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your misuse of the App, violation of these Terms, or infringement of any third-party rights.

12. Not Medical or Therapeutic Advice

The wellness challenges (such as guided breathing exercises) are for general wellbeing purposes only and do not constitute medical, psychological, or therapeutic advice. Consult a healthcare professional for any health concerns. Do not rely on the App as a substitute for professional medical advice, diagnosis, or treatment.

13. Accessibility

We are committed to making Detour accessible to all users. The App supports TalkBack screen reader on Android. If you encounter accessibility barriers, please contact us at xaesionai@gmail.com so we can improve.

14. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Material changes will be communicated through an app update notice. Continued use of the App after changes constitutes acceptance of the updated Terms.

15. Termination

You may stop using the App and delete it at any time. We reserve the right to suspend or terminate access to the App or specific features (including Connections) for violations of these Terms. Upon termination, your license to use the App is revoked, but provisions regarding intellectual property, limitation of liability, indemnification, and governing law survive.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Detour regarding your use of the App and supersede all prior agreements, understandings, and communications, whether written or oral.

18. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of the applicable jurisdiction.
